Site operator

The site is operated by Michele Tufano, Viale Sorrento 61, 60019 Senigallia (AN), Italia — VAT number 02845390422, tax code TFNMHL66L14B715Q, email tufanomichele@gmail.com. This information is given under Article 7 of Italian Legislative Decree 70/2003.

Subject matter and acceptance

Record Fair organises virtual record fairs: it provides exhibitors with online booths including item listings, a chat and video calls, and lets registered users visit them. Registering and using the site means accepting these terms in full; anyone who does not accept them must refrain from using the service.

Visitor accounts

Registering as a visitor is free and requires first name, last name, email address and country. The password is generated by the site and sent to the email address provided, which must therefore be valid and under the user's control. The account is personal and non-transferable: users keep their credentials safe and are answerable for the activity carried out with their account. Access to the halls is granted for the opening period shown on the fair page.

Exhibitors and booth assignment

Anyone wishing to take part as an exhibitor sends a request through the relevant form, providing their details, the booth name and the formats handled. The organisation reviews the request and approves or refuses it. The booth is assigned for a single fair, cannot be transferred or shared with other traders and must be used exclusively to display and sell records, music media and related collectables.

Prices and payment

The booth fee is stated on the fair participation page and is inclusive of taxes where due. Payment is made through PayPal, on the provider's pages; the booth is confirmed once the transaction is completed. The invoice or receipt is issued by the operator under the applicable tax rules.

Withdrawal and refunds

An exhibitor acting as a consumer may withdraw within fourteen days of entering into the contract by writing to tufanomichele@gmail.com; the right does not apply to those acting in the course of a business or profession. If the fair is cancelled by the operator, the fee paid is refunded in full. Withdrawal notified after the fair has opened gives no right to a refund.

Content published by exhibitors

Exhibitors are solely responsible for the texts, prices and photographs they upload and warrant that they may dispose of the items offered and hold the rights to the photographic material. It is forbidden to publish counterfeit or unlawfully reproduced media, material infringing copyright or trade marks, and goods whose sale is prohibited by law.

Sales between users

Sales are concluded directly between exhibitor and buyer, who agree price, payment and shipping outside the site. Record Fair only provides the meeting space and the shop window: it is not a party to the sale contract, does not collect the price of the items and is not liable for the conformity of the goods, for shipping or for the outcome of negotiations. Order notes sent from the private area are written and sent by the exhibitor under their own responsibility.

User conduct

In the chat, in video calls and anywhere else on the site it is forbidden to publish offensive, discriminatory or unlawful content, to send unsolicited commercial messages to other users, to collect data from the site by automated means, to attempt to access restricted areas or to interfere with the operation of the service.

Reports and measures

Anyone may report content believed to be unlawful to tufanomichele@gmail.com, indicating the page and the reason. Once the report has been checked, the operator may remove the content, suspend or close the account and, in the most serious cases, exclude the exhibitor from later fairs. In less serious cases removal is preceded by a warning.

Intellectual property

The Record Fair name, the logo, the graphics, the texts and the software of the site belong to the operator and may not be reproduced, distributed or modified without written authorisation. Content uploaded by exhibitors remains their property: by publishing it they grant the operator a free, non-exclusive licence to display it on the site and to promote the fair, for as long as it remains published.

Availability of the service

The service is provided without any guarantee of uninterrupted operation and also depends on external providers, such as the video call and payment services. The operator may suspend it for maintenance, updates or technical reasons, giving notice where possible, and may change the features of the site and the fair calendar.

Limitation of liability

The operator is liable for damage that is the immediate and direct consequence of its own breach. It is not liable for interruptions due to causes beyond its control, for the conduct of users, for data loss caused by third parties, or for indirect damage or loss of profit. Mandatory consumer rights and liability for wilful misconduct and gross negligence remain unaffected.

Changes to the terms

These terms may be updated. Changes are published on this page and, where significant, notified by email to registered users; fairs already paid for remain governed by the terms in force at the time of payment.

Applicable law and disputes

The relationship is governed by Italian law. Disputes with users acting as consumers fall under the jurisdiction of the court of the consumer's place of residence or domicile; in all other cases the court of Ancona has exclusive jurisdiction.
